Pondurance Security Alert Text Messaging Privacy Addendum

This Pondurance Security Alert Text Messaging Privacy Addendum supplements the Pondurance Privacy Policy and specifically governs the collection, use, disclosure, and protection of information associated with Pondurance’s text messaging program, including  security alert notifications, incident-related communications, authentication messages, and other operational or service-related communications.

Text Messaging Program

​

Pondurance may send text messages to authorized customer contacts identified in Pondurance’s customer portal regarding high-priority security alerts, active cybersecurity incidents, incident investigation updates, service-impacting events, account or platform notifications, and other operational communications related to Pondurance’s managed security services, technology platform, and monitored customer environments.

Information We Collect

For Pondurance’s text messaging program, the Company may collect and process the following information:

​

• Mobile telephone numbers;

• Names, job titles, company names, and business contact information for authorized customer contacts;

• Text messaging opt-in status and consent records;

• Message delivery, response, and opt-out records;

• Customer account, service, alert, or incident information needed to send relevant operational or security notifications.

How We Use Text Messaging Information

​

Pondurance may use text messaging information to:

​

• Send high-priority security alert notifications;

• Send cybersecurity incident-related updates;

• Send service-impacting or operational notifications;

• Administer the text messaging program;

• Maintain records of opt-in, opt-out, and messaging preferences;

• Provide customer support;

• Comply with applicable legal, regulatory, contractual, and security obligations.

No Sale or Marketing Sharing of Mobile Information

​

Pondurance does not sell, rent, purchase, or otherwise disclose mobile telephone numbers, text messaging opt-in data, or text messaging consent information to third parties for marketing or promotional purposes.

Pondurance does not share mobile information or text messaging opt-in consent with third parties or affiliates, service providers, or other third parties for their own marketing or promotional purposes.

All categories of information described in the Pondurance Privacy Policy expressly exclude text messaging originator opt-in data and consent records. Such information will not be shared with any third parties, except as necessary to deliver and support  the text messaging service, comply with applicable laws or legal obligations, prevent fraud or abuse, or protect the rights, property, systems, and security of Pondurance, its customers, or others.

Service Providers

​

Pondurance may use service providers, including telecommunications providers and messaging platforms, to transmit text messages on Pondurance’s behalf. These service providers are authorized to process mobile information solely to the extent necessary to perform messaging services for Pondurance and are strictly permitted to perform messaging services for Pondurance and are strictly prohibited from using such information for their own marketing, promotional, or unrelated commercial purposes.

Messaging Preferences and Opt-Out

​

Authorized customer contacts may manage SMS notification preferences through Pondurance’s customer portal, including enabling or disabling SMS notifications in accordance with customer-configured notification settings.

Recipients may also opt out of receiving Pondurance text messages by replying “STOP” to any Pondurance text message. Recipients may request help by replying “HELP” or by contacting Pondurance through the support channels identified in the Pondurance Security Alert Text Messaging Terms & Conditions.

Pondurance may maintain records of SMS notification preferences, opt-in status, opt-out status, and related messaging activity, as reasonably necessary to administer the text messaging program, ensure compliance with applicable laws and regulatory requirements, and honor recipient communication preferences.

Relationship to Pondurance Privacy Policy

​

This Addendum supplements the Pondurance Privacy Policy. In the event of any conflict or inconsistency  between this Addendum and the Pondurance Privacy Policy regarding text messaging originator opt-in data, consent, or mobile information used for the text messaging program, the terms of this Addendum shall prevail and control.

Dispute Resolution

​

The Pondurance Text Messaging Program shall be construed and enforced in accordance with the laws of the State of Virginia. Any dispute related to the Pondurance Text Messaging Program shall be filed in State or Federal Court located in Fairfax County, Virginia.
